Important Notice: By logging into the Odemny platform, you are agreeing to a legally binding contract. Odemny is provided "AS IS" as an empty infrastructure for educational environments. The Educational Institution using this software bears 100% of the responsibility for content monitoring and student activity.

1. Acceptance of Terms

By accessing and using the Odemny Student Search Engine ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, you are not authorized to use the Service.

2. Authorized Use

Odemny is an educational utility intended strictly for academic research and school-approved workflows. The Service dynamically restricts access to unauthorized domains based on criteria established exclusively by your institution's administration.

3. COPPA Compliance & Account Provisioning

Odemny is fully compliant with the Children's Online Privacy Protection Act (COPPA) because our infrastructure operates on a strictly "Zero-PII" (Personally Identifiable Information) basis. We do not collect, store, or profile student data.

CRITICAL OBLIGATION FOR SCHOOLS: To maintain this compliance, Educational Institutions are strictly prohibited from allowing students to log in using personal Google accounts containing real names or personal data. Institutions MUST provision generic, anonymized, or managed non-PII Google Workspace accounts for student access. If an Institution breaches this term, the Institution assumes total and sole liability for any COPPA violations.

4. School Monitoring Responsibility

Odemny provides the software infrastructure, but the Educational Institution is the sole curator of the network whitelist. Odemny does not proactively monitor, filter, censor, or review the specific content accessed through the platform.

The Institution bears 100% of the responsibility to actively monitor student activity, manage their whitelist, and ensure that the digital environment remains safe and compliant with their local policies and the Children's Internet Protection Act (CIPA).

5. Illegal & Harmful Activities

Users agree not to use the Service for any unlawful, illegal, or harmful activities. This includes, but is not limited to: copyright infringement, cyberbullying, accessing illicit material, distributing malware, or attempting network breaches.

Odemny disclaims all liability for any illegal acts committed by students or staff using the platform. If an illicit search is performed or harmful content is accessed via a school-approved whitelisted site, the liability falls entirely on the individual user and the overseeing Educational Institution.

6. Third-Party Content Liability

Odemny indexes and links to third-party websites (e.g., Wikipedia, educational portals) approved by your administration. Odemny does not author, control, or monitor the content hosted on these external platforms.

We are not responsible for inaccurate, offensive, pirated, or outdated information found on whitelisted third-party domains. Accessing these links is done strictly at your own risk.

You and your Educational Institution agree to defend, indemnify, and hold harmless Odemny, its creators, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service, student misuse of the platform, or any privacy violations stemming from improper account provisioning.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in New York.
